1. Acceptance of Terms

 

By downloading, installing, or using the Flora Sketch Android application ("the Service"), operated by Flora Sketch LLC, a Washington State limited liability company, you accept and agree to be bound by these Terms of Service.

 

If you do not agree to these terms, please do not download or use the Service. These terms govern your use of the Flora Sketch Android app available on the Google Play Store.

 

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your data.

 

2. Description of Service

 

Flora Sketch is an Android application that allows users to create, design, and manage garden layouts. The Service includes features for plant selection, garden visualization, cost estimation, and design storage. The app is available on the Google Play Store and supports mobile phones, tablets, and ChromeOS devices.

 

Paid subscriptions are available exclusively through the Android app via Google Play Billing. There is no web-based version of the app and no web-based payment system. Flora Sketch does operate a limited account deletion web page at florasketch.co/deleteaccount as required by Google Play's account deletion policy, and static informational pages for these Terms and the Privacy Policy. These pages are not a web app and do not provide access to garden design features.

 

3. Google Play Terms

 

If you download the mobile app from the Google Play Store, you acknowledge and agree that:

 

- These Terms are between you and Flora Sketch LLC, not Google LLC

- Google is not responsible for the Service or its content

- You must comply with Google's Terms of Service

- Google LLC and each member of the group of companies comprising Google are third-party beneficiaries of these Terms and are entitled to directly enforce any provision that confers a benefit or rights in their favor

- In-app purchases are processed through Google Play Billing

- You may use the app on Android devices you own or control that meet the minimum requirements: Android 7.0 (API level 24) or higher. Note: image uploads (available on Hobby and Pro tiers) require Android 13 (API level 33) or higher, as they use the Android Photo Picker which is only available on Android 13+

- App availability and functionality may vary based on your device's Android version, hardware, and Google Play compatibility. We do not guarantee the app will function on all Android devices

- Google is not responsible for addressing any claims relating to the app

 

4. User Accounts

 

To use certain features of the Service, you must create an account. You agree to:

 

- Provide accurate, current, and complete information during registration

- Maintain the security of your password and account

- Notify us immediately of any unauthorized use of your account

- Accept responsibility for all activities that occur under your account

- Be at least 13 years of age (or the minimum age required in your jurisdiction). By creating an account, you confirm that you meet this requirement. Age is self-certified at registration. If we become aware that an account was created by a person under 13, we will delete the account and associated data. See our Privacy Policy (Section 9) for our full COPPA compliance policy.

 

5. User Content and Ownership

 

You retain all rights to the garden designs, images, and other content you create using the Service ("User Content"). By using the Service, you grant us a limited license to store, display, and process your User Content solely for the purpose of providing the Service to you.

 

6. Acceptable Use

 

You agree not to:

 

- Use the Service for any illegal or unauthorized purpose

- Attempt to gain unauthorized access to the Service or its related systems

- Interfere with or disrupt the Service or servers

- Upload malicious code, viruses, or harmful content

- Harass, abuse, or harm other users

- Scrape, copy, or automatically extract data from the Service

- Impersonate any person or entity

 

7. Payments, Subscriptions & Refunds

 

7.1 Subscription Tiers:

 

A paid subscription is not required to use Flora Sketch. The Free tier is a permanent tier — it does not expire and does not convert to a paid subscription. There are no free trials or introductory pricing periods. The Free tier provides full access to the core garden design tools, including 1 garden with up to 100 plant instances, 100 hardscape instances, and 100 zone instances. Paid subscriptions unlock additional capacity and features:

 

- Free: 1 garden; up to 100 plant instances, 100 hardscape instances, and 100 zone instances per garden; no image uploads; no garden design export or plant list PDF download; no subscription required

- Hobby: Up to 100 gardens, unlimited plant instances, hardscapes, and zones; up to 250 uploaded assets; unlimited garden design and plant list PDF exports; available as a monthly or annual subscription that automatically renews

- Pro: Up to 500 gardens, unlimited plant instances, hardscapes, and zones; up to 1,000 uploaded assets; unlimited garden design and plant list PDF exports; available as a monthly or annual subscription that automatically renews

 

Paid subscriptions provide sustained, ongoing value throughout the life of the subscription. The features and capacity limits associated with your tier (gardens, plant instances, image uploads, PDF downloads, and all other tier-specific capabilities) are available to you continuously for as long as your subscription remains active and in good standing. We will not reduce or remove the core features of your subscribed tier during an active billing period. Any changes to subscription features will be communicated in advance in accordance with Section 14 (Changes to Terms) and Section 7.12 (Price Changes).

 

Current subscription prices are displayed on the in-app subscription screen and in the Google Play Store listing at the time of purchase. Prices are set in your local currency and may vary by region. The price confirmed in the Google Play Billing interface at the time of purchase is the binding price.

 

Paid subscriptions automatically renew at the end of each billing period (monthly or annually, depending on your selection) and your payment method will be charged automatically at the start of each new period, unless you cancel before the renewal date.

 

7.2 Payment Processing:

 

All paid subscriptions are purchased exclusively through the Android app on the Google Play Store via Google Play Billing. There is no separate web-based payment or subscription system.

 

- All payments are processed exclusively through Google Play Billing

- We do NOT store or have access to your credit card information

- By subscribing, you authorize the payment processor to charge your payment method

- Subscription fees are charged at the beginning of each billing period

- Prices displayed within the app match exactly the prices shown in the Google Play Billing interface. If any discrepancy exists, the price confirmed in the Google Play Billing interface at time of purchase governs

 

7.3 Subscription Management & Cancellation:

 

- You can manage or cancel your subscription at any time

- In-app cancellation: Open the Flora Sketch app, tap the menu icon, Account, scroll to Manage or Cancel Subscription. This will take you directly to your Google Play subscription management page

- Via Google Play directly: Visit Google Play Subscriptions and select Flora Sketch

- When you cancel, you keep access to paid features until the end of your current billing period

- No refund is issued for the current billing period upon cancellation — cancellation takes effect at the end of the period you have already paid for

- Your subscription will not renew after cancellation

- Users in some countries may be eligible to cancel immediately and receive a prorated refund in accordance with applicable local law, as determined by Google Play

 

7.4 Subscription Pause:

 

Google Play may offer an option to pause your subscription instead of cancelling it. When available, this option appears in the Google Play Subscriptions center and in the cancellation flow.

 

- What pause means: Your subscription is temporarily suspended for a period you choose (between one week and three months, depending on your billing interval). You do not have access to paid features in Flora Sketch while the subscription is paused. Your gardens and uploaded assets are fully preserved during the pause.

- Resumption: At the end of the pause period, your subscription automatically resumes and Google charges your payment method for the next billing period. Access to paid features is restored immediately upon successful renewal.

- Availability: Pause is not available for annual subscriptions. Availability may vary by region and is controlled by Google Play, not Flora Sketch LLC.

- How to pause: Visit Google Play Subscriptions and select Flora Sketch. If the pause option is available for your plan, it will appear there.

 

7.5 Subscription Tier Changes (Upgrade):

 

You may upgrade from a lower tier to a higher tier (Free to Hobby, Free to Pro, or Hobby to Pro) at any time. The following rules apply:

 

- Immediate effect: An upgrade takes effect immediately upon successful purchase through Google Play. Your new tier's features, garden limit, and upload limit are available right away.

- Proration — handled by Google Play: If you upgrade mid-billing-period, Google Play automatically applies a prorated credit for unused days on your current plan toward the cost of the new plan. Flora Sketch LLC does not receive or control this credit; it is managed entirely by Google.

- No cash refund for the current period: No cash refund is issued for remaining days of your previous plan's billing period. The unused value is credited by Google toward your upgrade charge as described above.

- Cancels any pending downgrade: If you have a scheduled downgrade pending, completing an upgrade will cancel that scheduled downgrade immediately.

- Monthly / Annual switching: Switching between monthly and annual billing intervals for the same tier is handled through Google Play. Timing and proration for interval changes follow Google Play's current subscription policies, which may differ by region.

- Billing handled by Google Play: All upgrades are processed exclusively through Google Play Billing. Flora Sketch LLC does not collect or store your payment information.

 

7.6 Subscription Tier Changes (Downgrade):

 

You may switch from a higher-paid tier (Pro or Hobby) to a lower tier (Hobby or Free) at any time. The following rules apply:

 

- Scheduled, not immediate: A downgrade is scheduled to take effect at the end of your current billing period. You retain full access to your current tier's features until that date.

- Gardens are never deleted: All of your existing gardens are preserved after a downgrade. However, if your garden count exceeds the new tier's limit, you will be unable to create new gardens until you have deleted gardens down to within the new limit.

- Uploaded images — deletion of excess assets: If your number of uploaded images exceeds the new tier's upload limit (Hobby: 250 uploads; Free: 0 uploads), the oldest uploads over the limit will be permanently deleted. This deletion occurs at or shortly after the downgrade effective date. You should download any uploaded images you wish to keep before the downgrade takes effect. Gardens that referenced a deleted image will display a placeholder instead.

- Free tier: The Free tier does not permit image uploads. Downgrading to Free will result in deletion of all uploaded images at the time the downgrade takes effect.

- No refund for the current billing period: Downgrades do not entitle you to a refund for the remaining days of the current billing period. Your paid-tier access continues until the end of the period you have already paid for.

- Reversal: You may re-upgrade your subscription at any time before or after the downgrade takes effect. Re-upgrading before the effective date will cancel the scheduled downgrade.

 

We will display the specific downgrade date, the number of uploads that will be affected, and which specific files are queued for deletion (oldest first) within the app before you confirm the downgrade, so you have a clear opportunity to review and download any assets you wish to retain.

 

7.7 Refund Policy:

 

All Flora Sketch subscriptions are purchased exclusively through Google Play Billing. Refunds are governed by Google's refund policy. We do not process refunds directly. To request a refund:

 

- Visit Google Play Subscriptions or contact Google Play Support. Refund eligibility is determined by Google on a case-by-case basis in accordance with Google Play's refund policy.

 

Developer escalation: If you are unable to resolve a refund issue through Google Play and believe you have a statutory entitlement to a refund under the laws of your country of residence (including rights under the EU Consumer Rights Directive, UK Consumer Contracts Regulations, or any other applicable mandatory consumer protection law), you may also contact us directly at florasketch@proton.me. While Flora Sketch LLC is not the merchant of record and cannot process Google Play transactions directly, we will make reasonable efforts to assist you in resolving the dispute with Google Play, and EU/EEA consumers may additionally use the EU Online Dispute Resolution platform.

 

7.8 UK Consumer Rights - 14-Day Cooling-Off Period:

 

For UK consumers only: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a statutory right to cancel your subscription within 14 days of purchase without providing a reason.

 

Because all Flora Sketch subscriptions on Android are purchased exclusively through Google Play Billing, Google acts as the merchant of record for your transaction. Flora Sketch LLC does not receive your payment details and cannot process refunds directly. To exercise your 14-day statutory cancellation right, you must submit your request through Google Play:

 

- Visit Google Play Subscriptions to cancel your subscription

- Request a refund: Contact Google Play Support and cite your statutory 14-day cooling-off right under UK Consumer Contracts Regulations 2013

- Refund entitlement: If you have not accessed any paid features during the 14-day period, you are entitled to a full refund. If you have already accessed paid features, you are entitled to a proportionate refund for the unused portion of the service, in accordance with Regulation 36 of the Consumer Contracts Regulations 2013. Because Google acts as the merchant of record, the refund is processed by Google Play — but the amount is determined by your statutory entitlement under UK law, not by Google's discretion

- This statutory right is in addition to Google Play's standard refund policy

 

7.9 EU Consumer Rights - 14-Day Right of Withdrawal:

 

For consumers in the European Union (EEA) only: Under the EU Consumer Rights Directive 2011/83/EU (implemented in each EU/EEA member state), you have a statutory right to withdraw from your subscription contract within 14 days of the date of purchase without giving any reason (the "withdrawal period").

 

Because all Flora Sketch subscriptions on Android are purchased exclusively through Google Play Billing, Google acts as the merchant of record for your transaction. Flora Sketch LLC does not receive your payment details and cannot process refunds directly. To exercise your 14-day statutory right of withdrawal, you must submit your request through Google Play:

 

- Cancel your subscription: Visit Google Play Subscriptions and cancel your Flora Sketch subscription

- Request a refund: Contact Google Play Support and cite your statutory 14-day right of withdrawal under EU Consumer Rights Directive 2011/83/EU

- Refund entitlement: If you have not accessed any paid features during the 14-day withdrawal period, you are entitled to a full refund. If you expressly requested that the service begin during the withdrawal period and have already accessed paid features, you are entitled to a proportionate refund for the unused portion of the service, in accordance with Article 14(3) of Directive 2011/83/EU. Because Google acts as the merchant of record, the refund is processed by Google Play — but the amount is determined by your statutory entitlement under EU law

- This statutory right is in addition to Google Play's standard refund policy

- This right does not affect any other mandatory consumer protection rights you may have under the law of your EU/EEA member state

 

If you are unable to resolve a refund issue through Google Play and believe you have a statutory entitlement under EU law, you may also contact us at florasketch@proton.me for assistance. EU consumers also have the right to use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes.

 

7.10 Auto-Renewal:

 

All paid subscriptions automatically renew at the end of each billing period. Your payment method on file with Google Play will be charged automatically at the start of each renewal period at the then-current subscription price, unless you cancel before the renewal date. Cancellation takes effect at the end of the current billing period — you will not be charged again after cancelling.

 

Because all subscriptions are billed through Google Play Billing, renewal notifications are sent by Google, not by Flora Sketch LLC. Google sends renewal reminders for annual subscriptions before they renew. You can review your upcoming renewal dates and amounts at any time in your Google Play Subscriptions page.

 

- Renewal reminder emails are sent by Google Play, not Flora Sketch

- To check your renewal date and amount, visit your Google Play Subscriptions page

- To cancel before renewal, manage your subscription through Google Play before the renewal date

 

7.11 Payment Failure, Grace Period & Account Hold:

 

Because all subscriptions are managed through Google Play Billing, Google controls the payment retry process. If a renewal payment fails, Google may apply the following states to your subscription — which directly affects your access to Flora Sketch:

 

- Grace Period (access retained): Immediately after a failed renewal payment, Google enters a grace period of up to 3 days (weekly subscriptions) or 30 days (monthly/annual subscriptions). During this time, your subscription remains active and you retain full access to all paid features. Google automatically retries your payment method during this period. You will receive notifications from Google asking you to update your payment information.

- Account Hold (access suspended): If payment is not recovered by the end of the grace period, Google places your subscription into account hold. Your access to paid features in Flora Sketch will be suspended until the payment issue is resolved. Your gardens and uploaded data are preserved and will be fully accessible again once your subscription is restored — nothing is deleted during account hold.

- Restoring access: To restore access during account hold, update your payment method in the Google Play Subscriptions page. Once Google successfully processes a payment, your subscription and full access are restored automatically.

- Subscription expiry: If account hold continues without payment recovery until the original subscription end date, Google cancels the subscription entirely. At that point, your account reverts to the Free tier. Your existing gardens are kept, but paid-tier features (additional gardens beyond the free limit, photo uploads) will no longer be accessible until you re-subscribe.

 

Flora Sketch LLC does not control the grace period duration, retry schedule, or account hold behavior — these are managed entirely by Google Play. For help updating your payment method, visit Google Play's payment help page.

 

7.12 Price Changes:

 

- We reserve the right to change subscription prices with advance notice

- Because all subscriptions are managed through Google Play Billing, Google handles the price change notification process: if your subscription price increases, Google will notify you by email and via an in-app notification before the change takes effect. You must actively opt in to the new price before your next renewal, or your subscription will not renew and will be cancelled instead

- You will never be charged a higher price without first receiving advance notice and having the opportunity to opt in or cancel

- Price changes take effect at the next renewal after the opt-in period has elapsed

- You can review your current subscription price and renewal date at any time in your Google Play Subscriptions page

- You may cancel before any price change takes effect

 

8. Intellectual Property

 

The Service, including its original content, features, and functionality, is owned by Flora Sketch and is protected by international copyright, trademark, and other intellectual property laws. Plant images, descriptions, and data provided within the Service may be sourced from third parties and are subject to their respective licenses.

 

9. Disclaimer of Warranties

 

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

 

- The Service will be uninterrupted, secure, or error-free

- Plant information or design recommendations will be accurate or complete

- Any defects will be corrected

- The Service will meet your specific requirements

 

EU/EEA and UK consumers: Notwithstanding the above, if you are a consumer resident in a European Union or European Economic Area member state, or in the United Kingdom, nothing in this section excludes or limits any statutory warranties or rights that cannot be waived or limited under the mandatory consumer protection laws of your country of residence (including, without limitation, rights under the EU Consumer Rights Directive 2011/83/EU, the UK Consumer Rights Act 2015, or any equivalent applicable law). To the extent of any conflict, those mandatory statutory rights prevail.

 

10. Limitation of Liability

 

To the fullest extent permitted by applicable law, Flora Sketch LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or other intangible losses, arising out of or in connection with your use of or inability to use the Service. This exclusion applies regardless of the legal theory under which such damages are claimed and even if Flora Sketch LLC has been advised of the possibility of such damages. For the monetary cap on Flora Sketch LLC's total liability, see Section 16.

 

EU/EEA and UK consumers: Notwithstanding the above, if you are a consumer resident in a European Union or European Economic Area member state, or in the United Kingdom, nothing in this section excludes or limits Flora Sketch LLC's liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the mandatory consumer protection laws of your country of residence. To the extent of any conflict between this section and such mandatory laws, the mandatory laws of your country of residence prevail.

 

11. Gardening Disclaimer

 

Flora Sketch is a design tool only. We do not provide professional gardening, landscaping, or horticultural advice. Plant selections, spacing recommendations, and design suggestions should be verified with local experts, nurseries, or agricultural extension services. Actual plant growth, compatibility, and success may vary based on local conditions, climate, soil, and care practices.

 

Our plant database contains botanical characteristics (such as hardiness zones, sun requirements, and care instructions) that were partly generated with AI assistance during database development. This AI-generated data is flagged with a visible disclaimer within the app's plant detail screens. It is provided for general reference only and should be verified with authoritative local sources before making planting decisions.

 

12. Account Deletion and Termination

 

12.1 User-Initiated Account Deletion:

 

In compliance with Google Play requirements, GDPR, and CCPA, you have the right to delete your account and all associated data at any time. You can initiate account deletion through any of the following methods:

 

- In-App: Navigate to Account Settings > Delete Account within the Flora Sketch app

- Online Form: Submit a deletion request at https://florasketch.co/deleteaccount (this web form is provided solely for account deletion requests and is not a web version of the app)

- Email: Contact us at florasketch@proton.me with your account deletion request

 

When you delete your account:

 

- What Gets Deleted: All of your data is permanently deleted — including all garden designs, plants, uploaded assets, account information, and subscription details

- Timeline: Your account and all associated data are deleted immediately upon request. Backup copies are purged within 7 days.

- Irreversibility: Account deletion is permanent and cannot be undone. No recovery is available after deletion

- Exceptions: We may retain limited data only if required by law (for example, financial records for tax purposes), but personal identifiers are removed

- Subscriptions: Deleting your account does not automatically cancel an active Google Play subscription. Because billing is managed entirely by Google Play, your subscription will continue to renew and you will continue to be charged until you cancel it directly through Google Play — regardless of whether your Flora Sketch account still exists. Cancel your subscription first via Google Play Subscriptions before requesting account deletion to avoid further charges. Flora Sketch LLC is not responsible for charges incurred after account deletion due to a subscription that was not cancelled through Google Play.

 

12.2 Company-Initiated Termination:

 

We reserve the right to suspend or terminate your account and access to the Service for cause, including conduct that violates these Terms, is harmful to other users, Flora Sketch LLC, or third parties, or violates applicable law. For serious or clear violations (such as abuse, fraud, or illegal activity), we may act without advance notice. For less severe violations, we will make reasonable efforts to notify you before taking action.

 

If your account is terminated for cause, no refund will be issued for any unused portion of a current billing period, as the termination results from your violation of these Terms. If we terminate your account without cause, any active paid subscriber will receive a prorated refund for the unused portion of the current billing period, processed through Google Play Support.

 

12.3 Service Discontinuation:

 

If we decide to permanently discontinue the Service, we will provide at least 30 days' advance notice to all registered users via email. For active paid subscribers, the following applies:

 

- Access: You will retain access to paid features through the end of your current billing period, or until the Service shutdown date — whichever comes first

- Refunds: If the Service is discontinued before the end of a billing period you have already paid for, you may be entitled to a prorated refund for the unused portion. Because all subscriptions are billed through Google Play Billing, refund requests must be submitted to Google Play Support. We will cooperate with Google to facilitate refunds to affected subscribers

- Data export: You will have at least 30 days to export your garden designs before shutdown using the built-in export tool

 

13. Data Backup and Loss

 

While we implement backup procedures, you are responsible for maintaining copies of your garden designs. We recommend regularly exporting your designs using the built-in export tool: tap the download icon in the garden canvas toolbar to save your garden as an SVG layout file and a PDF plant shopping list to your device. We are not responsible for any loss of User Content due to technical failures, account termination, or any other reason.

 

14. Changes to Terms

 

We reserve the right to modify these Terms at any time. For material changes — including changes to subscription pricing, subscription features, cancellation policy, account deletion process, data practices, user rights, or limitations of liability — we will provide at least 30 days' advance notice via email to your registered address or through a prominent notice in the Service. Non-material changes (such as corrections, clarifications, or changes required by law) may take effect immediately. Your continued use of the Service after the notice period constitutes your acceptance of the updated Terms.

 

15. Governing Law and Jurisdiction

 

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, USA, without regard to conflict of law provisions.

 

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Spokane County, Washington State.

 

EU/EEA and UK consumers — mandatory consumer protection laws: Notwithstanding the choice of Washington State law above, if you are a consumer resident in a European Union or European Economic Area member state, or in the United Kingdom, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the mandatory consumer protection laws of your country of residence (in accordance with EU Regulation 593/2008 (Rome I) and, for UK residents, the equivalent retained UK law). In any conflict between these Terms and such mandatory provisions, the mandatory provisions of your country's law prevail to the extent of the conflict.

 

EU/EEA jurisdiction: If you are a consumer resident in the EU or EEA, you may bring proceedings in the courts of your country of residence, in addition to or instead of the courts of Spokane County, Washington State. You may also use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes out of court.

 

UK jurisdiction: If you are a consumer resident in the United Kingdom, you may bring proceedings in the courts of England and Wales, Scotland, or Northern Ireland (as applicable to your place of residence), in addition to or instead of the courts of Spokane County, Washington State.

 

16. Monetary Cap on Liability (Washington State)

 

In addition to the exclusions in Section 10, and as a Washington State LLC, Flora Sketch LLC's total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the Service — regardless of the form of action or the basis of the claim — shall not exceed the greater of: (a) the total amount you paid to Flora Sketch LLC in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD $10.00. This cap applies to the fullest extent permitted by Washington State law.

 

Note: Some jurisdictions do not allow limitations on implied warranties or aggregate liability, so the above cap may not apply to you. EU/EEA and UK consumers: see the consumer carve-out in Section 10.

 

17. Indemnification

 

You agree to indemnify, defend, and hold harmless Flora Sketch LLC, its officers, directors, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

 

- Your use or misuse of the Service

- Your violation of these Terms

- Your violation of any third-party rights

- Your User Content

 

18. Export Compliance

 

You agree to comply with all applicable export and import laws and regulations.
