Terms of Service

1. Acceptance of Terms

By accessing and using Flora Sketch ("the Service"), operated by Flora Sketch LLC, a Washington State limited liability company, you accept and agree to be bound by these Terms of Service.

If you do not agree to these terms, please do not use the Service. These terms apply whether you access the Service via web browser, mobile app (iOS/Android), or any other platform.

2. Description of Service

Flora Sketch is a web and mobile application that allows users to create, design, and manage garden layouts. The Service includes features for plant selection, garden visualization, cost estimation, and design storage.

The Service may be accessed via web browser or through mobile applications available on the Apple App Store and Google Play Store, subject to additional terms from those platforms.

3. App Store Terms

If you download the mobile app from the Apple App Store or Google Play Store, you acknowledge and agree that:

• These Terms are between you and Flora Sketch LLC, not Apple Inc. or Google LLC
• Apple and Google are not responsible for the Service or its content
• You must comply with Apple's and Google's respective Terms of Service
• Apple and Google are third-party beneficiaries of these Terms and have the right to enforce them
• In-app purchases (if applicable) are processed through Apple or Google's payment systems

Apple-Specific Terms:
• You may only use the app on Apple-branded devices you own or control
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for addressing any claims relating to the app

Google-Specific Terms:
• You may use the app on Android devices you own or control
• Google is not responsible for the app or any claims relating to it

4. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account
• Be at least 13 years of age (or the minimum age required in your jurisdiction)

5. User Content and Ownership

You retain all rights to the garden designs, images, and other content you create using the Service ("User Content"). By using the Service, you grant us a limited license to store, display, and process your User Content solely for the purpose of providing the Service to you.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Scrape, copy, or automatically extract data from the Service
• Impersonate any person or entity

7. Payments, Subscriptions & Refunds

7.1 Subscription Tiers:

Flora Sketch offers multiple subscription tiers (Free, Hobby, Pro) with different feature limits and storage allocations. Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your selection).

7.2 Payment Processing:

• All payments are processed by third-party payment processors (Google Play Billing, Apple App Store, or Stripe)
• We do NOT store or have access to your credit card information
• By subscribing, you authorize the payment processor to charge your payment method
• Subscription fees are charged at the beginning of each billing period

7.3 Cancellation:

• You may cancel your subscription at any time through your account settings or the platform you purchased from (Google Play, Apple App Store, or Stripe)
• Cancellations take effect at the end of your current billing period
• You will retain access to paid features until the end of your paid period
• No partial refunds are provided for unused time within a billing period unless required by law

7.4 Refund Policy:

For purchases through Google Play Store or Apple App Store: Refunds are governed by Google's and Apple's respective refund policies. We do not process refunds directly for platform purchases. To request a refund:

• Google Play: Visit https://play.google.com/store/account/subscriptions or contact Google Play Support. Google Play provides an automated refund window of 48 hours for new subscriptions. After 48 hours, refund requests are reviewed on a case-by-case basis and subject to developer approval
• Apple App Store: Visit https://reportaproblem.apple.com/ or contact Apple Support
• Stripe (web purchases): Contact our support team at florasketch@proton.me within 14 days of purchase. Refund eligibility will be reviewed on a case-by-case basis

Refund Eligibility (for direct Stripe purchases only):

• Refunds may be granted within 14 days of initial purchase if you experienced technical issues preventing use of the Service
• Refunds are NOT provided for: change of mind, lack of use, or dissatisfaction with features after the 14-day period
• Refunds are issued to the original payment method within 5-10 business days
• Refunded accounts will revert to the Free tier immediately

7.5 Price Changes:

• We reserve the right to change subscription prices with 30 days' advance notice
• Price changes apply to renewals after the notice period
• Existing subscribers will receive email notification of price changes
• You may cancel before the price change takes effect

7.6 Free Trial (if applicable):

• Free trials, if offered, automatically convert to paid subscriptions unless cancelled before the trial ends
• You must provide payment information to start a free trial
• You will receive a reminder email before your trial ends and billing begins
• Cancel anytime during the trial to avoid charges

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Flora Sketch and is protected by international copyright, trademark, and other intellectual property laws. Plant images, descriptions, and data provided within the Service may be sourced from third parties and are subject to their respective licenses.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• Plant information or design recommendations will be accurate or complete
• Any defects will be corrected
• The Service will meet your specific requirements

10. Limitation of Liability

To the fullest extent permitted by law, Flora Sketch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Service.

11. Gardening Disclaimer

Flora Sketch is a design tool only. We do not provide professional gardening, landscaping, or horticultural advice. Plant selections, spacing recommendations, and design suggestions should be verified with local experts, nurseries, or agricultural extension services. Actual plant growth, compatibility, and success may vary based on local conditions, climate, soil, and care practices.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

13. Data Backup and Loss

While we implement backup procedures, you are responsible for maintaining copies of your garden designs. We recommend regularly exporting your designs. We are not responsible for any loss of User Content due to technical failures, account termination, or any other reason.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through a notice in the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, USA, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in King County, Washington State.

Exception: If you are located in the European Union, you may also have the right to bring disputes in your country of residence.

16. Limitation of Liability (Washington State)

As a Washington State LLC, Flora Sketch LLC's liability is limited as follows:

• Total liability shall not exceed the amount you paid for the Service in the 12 months prior to the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not liable for loss of profits, data, business opportunities, or goodwill
• These limitations apply to the fullest extent permitted by Washington State law

Some jurisdictions do not allow limitations on implied warranties or liability, so the above limitations may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless Flora Sketch LLC, its officers, directors, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

18. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
